GUIDELINES FOR ACCREDITATION OF ORGANIZATIONS

Pursuant to the authority vested by law on the National Anti-Poverty Commission (NAPC), through its Lead Convenor, the following Guidelines are hereby adopted and promulgated:

 

I.       RATIONALE

 

          Republic Act No. 8425, otherwise known as The Social Reform and Poverty Alleviation Act, defines basic sectors as the disadvantaged sectors of Philippine society, consisting of farmers and rural landless workers, artisanal fisherfolk, workers in the formal sector and migrant workers, workers in the informal sector, urban poor, indigenous peoples and cultural communities, women, children, youth and students, senior citizens, victims of disasters and calamities, and persons with disabilities.  Considering that their memberships include people from the aforementioned sectors, cooperatives and non-government organizations are also included in the category of basic sectors. 

 

          As the focal agency for poverty alleviation of the government, the National Anti-Poverty Commission (NAPC), an organization established under RA 8425, has engaged the basic sectors in meaningful and effective participation in various areas of governance.   These areas include policy and program development, planning, coordination, and monitoring and evaluation of all anti-poverty efforts.   The NAPC gives the basic sectors opportunities to increase the support for their advocacies and ensure continuous focus on their concerns. 

 

The mentioned engagement has allowed the basic sectors to strongly influence the shaping of the social, political and economic agenda, as well as the development prospect of the country.  

 

Since basic sector organizations tend to affect the lives and livelihood of people who comprise a large part of Philippine society, it is imperative for government to ensure that said basic sector organizations intending to participate in the NAPC come from the broadest geographical base spanning the length and breadth of the Philippine archipelago; are greater in number than those that were or are currently engaged in the NAPC; are legitimate; and have their respective valid reform agenda for their sectors.  

 

Therefore, a promotion and accreditation process is in order.

 


II.      SCOPE AND AUTHORITY

 

          For the guidance of all concerned, the following are the Guidelines for the Accreditation of Organizations intending to engage in the participatory processes of the NAPC.  These Guidelines are issued pursuant to the provisions of Administrative Order No. 187, series of 2007,  entitled Revised Rules and Regulations Implementing Title I, Section 6 of Republic Act No. 8425, otherwise known as the Social Reform and Poverty Alleviation Act that was signed on July 30, 2007.

 

 

III.    DEFINITION OF TERMS

 

Accreditation refers to the process wherein the Office of the President (OP) issues a certificate to an organization that has complied with all the requirements, as herein prescribed, for it to participate in the NAPC, unless otherwise indicated.

 

Armed Struggle refers to the use of violence for the overthrow of the duly constituted government or authorities of the Philippines.

 

Lead Agency refers to the National Government Agency (NGA) that is identified, based on its mandate, by the NAPC Secretariat to be the primary partner of the Basic Sector in the implementation of its sectoral agenda.  The lead agency may or may not have regional offices.

 

Organization refers to a group of people or individuals who voluntarily and intentionally organize to accomplish an overall common goal or set of goals.

 

Organization with Local Constituency refers to any Non-Governmental Organization or People’s Organization that is operating, serving, and carrying out the agenda of basic or marginalized sectors within a region, province, municipality, barangay, or specific area or location in any of the three major islands of the Philippines (Luzon, Visayas, and Mindanao) it seeks to represent.

 

Organization with National Constituency refers to any Non-Governmental Organization or People’s Organization that is operating, serving, and carrying out the agenda of basic or marginalized sectors in the three major islands of the Philippines (Luzon, Visayas, and Mindanao) and in the National Capital Region (NCR) through their partners or representatives.

 

Recognition refers to an expressed acceptance by word or by deed of the existence, intents, and contributions to sectoral development of an organization.

 

 

 

IV.     BASIC REQUIREMENTS FOR ACCREDITATION

 

To secure a Certificate of Accreditation, an organization must comply with the following requirements:

 

A.    For Organizations with National Constituency:

 

1.     The national organization must be SEC-registered, CDA-registered, or recognized/ registered/ accredited by the lead NGA involved with the particular sector.

 

2.     The national organization must have been active for the last two (2) years, as supported by any three (3) of the following documents:

 

a.      Financial records or bank statements;  

b.      Documentation/Minutes of board meetings;

c.      Accomplishment reports;

d.     Advocacy programs; or,

e.      Other documents as may be determined by the lead NGA concerned (ex. master list of member-organizations).

 

3.     The national organization must issue under oath a Certification or Board Resolution stating that its head or board of directors, as the case may be, and its members, do not, directly or indirectly, espouse or support any form of armed struggle.

 

B.     For Organizations with Local Constituency:

 

1.     The local organization must secure a Certification, from the concerned units or offices of the Local Government Units and the lead NGA, that it has been actively participating in, and advocating and lobbying for, the legislative/executive program or agenda of the basic sectors over the last two (2) years.

 

2.     The local organization must issue under oath a Certification or Board Resolution stating that its head or board of directors, as the case may be, and its members, do not, directly or indirectly, espouse or support any form of armed struggle.

 

C.     For Representatives of the Organizations

 

1.     He or she must be the present head of the organization or an active and current officer of said organization authorized to represent the organization through an appropriate Board Resolution or equivalent document from the organization. 

 

2.     He or she must secure the following Clearances:

 

a.      Barangay clearance;

b.     Police clearance; and

c.      NBI clearance (for a representative of an organization with national constituency).

 

         Provided, that if the organization with local constituency of a representative is selected by election (please see VI.A.3, VI.A.4, and VI.A.5) as among those to be nominated, either as principal or alternate nominee,   by the region to be accredited by the OP to participate in the Sectoral General Assembly, said representative of the organization with local constituency must secure an NBI clearance.

 

Provided further, that for the representative of the children sector, a barangay clearance shall suffice.

 

3.     He or she must sign a Declaration of Allegiance denouncing direct or indirect support for armed struggle (Annex A).

 

4.     He or she must not have been a member of a sectoral council for two (2) terms of three (3) years each, starting from the year 1999.

 

 

V.      ACCREDITATION SECRETARIAT

 

The NAPC shall act as the Secretariat tasked to process the accreditation of organizations. For this purpose, it shall tap the Regional Development Councils and the Regional Kalahi Convergence Groups to assist in the process at the regional level. It shall organize agency clusters composed and vested with functions, as follows:

Each cluster shall be joined by its concerned Sectoral Representative (SR)/ Officer-in-Charge (OIC).  The Sectoral Councils that do not have appointed SRs shall issue a Resolution or Authorization Letter that shall identify the OIC tasked to represent the council in the clusters.  This document shall be submitted to the NAPC Secretariat. 

 

Subject to the approval of the NAPC Lead Convenor, the lead agencies may include other partner agencies at the final stage of the accreditation process. Agency representatives in the clusters shall be authorized in writing by the agency head to participate in the cluster activities.

 

The Lead Convenor shall recommend to the OP the accreditation of organizations approved by the clusters.

 

B.    Functions

 

1.     Convene and observe parliamentary procedures in the conduct of meetings;

 

2.     Validate and evaluate organizations that shall participate in the Sectoral General Assembly based on the unique character and needs of each sector, subject to the endorsement of the NAPC Secretary and Lead Convenor, and the approval of the OP;

 

3.     Report results of validation to the Lead Convenor; and

 

4.     Perform other functions as may be required by the NAPC Secretary and Lead Convenor.

 

 

VI.     PROCEDURES FOR ACCREDITATION

 

A.    For Organizations with Local Constituency:

 

1.     The Organization:

 

a.      Must accomplish the following application for accreditation forms in addition to the requirements mentioned in III.B:

 

                                                                        i.        Form 1. Declaration of Allegiance (Annex A)

                                  ii.        Form 2. Checklist of Accreditation Requirements (Annex B)

                                                                    iii.        Form 3. Organizational Profile (Annex C)

 

b.     Must submit its accreditation requirements to the regional offices of lead agencies as follows:

In the case of the NYC and the NCFRFW which have no regional line agencies, the concerned POs/ NGOs from the youth and student sectors and women shall submit their respective accreditation requirements to the NAPC focal person temporarily based in the NEDA regional offices or the NEDA RKCG focal person. The NAPC focal person or the NEDA RKCG focal person shall then forward the submitted accreditation requirements to the NAPC Secretariat that shall, in turn, forward said accreditation requirements to the office of the lead agency.  

 

In the case of the PCUP and the HUDCC, which are the agencies in charge of the urban poor sector, these agencies shall formulate their own mechanics for turnover of documents from the HUDCC in areas where the PCUP has no regional office.

 

2.     The Regional Offices of Lead Agencies shall:

 

c.      Receive applications from organizations with local constituency;

d.     Invite Basic Sector Council (BSC) representatives in the region to assist in the evaluation and validation of the documents and information submitted by an organization;

e.      Check for completeness of documents, with the assistance of the BSC representative;

 

f.       Validate the information provided, with the assistance of the BSC representative;

g.     Submit the list and documents of qualified organizations to the NEDA-Regional Development Council; and

h.     Inform the local organization whose application is found deficient about such fact and the negative finding/s and/or decision.

 

3.     The NEDA-Regional Development Councils shall: 

 

i.        Review and evaluate endorsements submitted by the regional line agencies, with the assistance of the Regional Kalahi Convergence Groups (RKCGs);

j.       Conduct elections among the organizations indorsed by the regional agencies that shall select the five principal and the five alternate regional indorsees, for accreditation by the OP, that shall participate in the Sectoral General Assembly; and

k.      Submit the list of elected POs/ NGOs to the NAPC Secretariat.

 

4.       The NAPC Secretariat shall:

 

l.        Conduct the same elections, referred to in 3.j above, in the NCR.

 

             5.  The Autonomous Region in Muslim Mindanao (ARMM) shall:

 

m. Conduct the regional accreditation process according to the above-prescribed procedures, subject to the extent allowed by its institutional structure.  Accordingly, initial sectoral qualification shall be done by the ARMM offices corresponding to the identified lead NGAs, and the regional elections among pre-qualified local organizations shall be conducted by its Regional Economic and Development Planning Board in coordination with the Presidential Assistant for Regional Development.

 

B.     For Organizations with National Constituency:

 

1.     The Organization:

 

a.      Must accomplish the following application for accreditation forms in addition to the requirements mentioned in III.A.:

 

i.   Form 1. Declaration of Allegiance (Annex A)

ii.  Form 2. Checklist of Accreditation Requirements (Annex B)

iii. Form 3. Organizational Profile (Annex C)

 

b.     Must submit its accreditation requirements to the NGAs as follows:

2.     The NGAs shall:

 

c.      Receive applications from organizations with national constituency;

d.     Check for completeness of documents;

e.      Validate the information provided;

f.       Submit the list and documents of qualified organizations to the NAPC Secretariat; and

g.     Inform the national organization whose application is found deficient about such fact and the negative finding/s and/or decision.

 

C. For Both Organizations with Local or National Constituency:

 

1.        The NAPC Secretariat shall:

 

h.     Receive documents from the NGAs and RDCs;

i.        Endorse documents to the clusters;

j.       Convene the clusters; and

 

k.      Inform organizations found deficient in the various stages of the accreditation process, motu proprio, through the clusters,  or through the OP, about such fact and the negative finding/s and/or decision.

 

2.        The NAPC Clusters shall:

 

l.        Review and evaluate endorsements made by the NAPC Secretariat, with the assistance of the Sectoral Representatives or OICs. (The NAPC Cluster Review for Organizations with Local Constituency and Organizations with National Constituency shall be done simultaneously in the same session).

m.   Shortlist organizations with local or national constituency per sector according to the following composition:

 

                                                                            i.            At least twenty percent (20%) representation from organizations with national constituency;

                                                                          ii.            At least five percent (5%) representation from each administrative  region; and

                                                                        iii.            At least thirty percent (30%) representation from organizations with women representatives.

 

Provided, that the abovementioned composition shall be consistent with the distinct characteristics of each sector.

 

Provided further, that no national organization and local organization with the same name shall be included in the shortlist. In such a case, the national organization shall give way to its local chapters, and shall be disqualified from further processes of accreditation.

 

n.     Submit the shortlist of organizations to the Lead Convenor.

 

 

3.     The Lead Convenor shall:

 

o.     Recommend organizations for accreditation by the OP.

 

 

VII.    THE CERTIFICATE OF ACCREDITATION

 

          The OP shall issue the requisite Certificate of Accreditation (Annex D).  The Certificate of Accreditation shall, among others, state the name and the sectoral classification of the organization, and also contain its period of validity subject to the discretion of the OP. 

 

          The OP reserves the right to verify the contents of documents submitted by organizations that form part of the accreditation process.  Further, the OP shall motu proprio set the number of organizations it shall accredit.

 

VIII.  MISCELLANEOUS PROVISIONS

 

          A. Separability Clause:

 

          If any provision or part of these Guidelines, or the application of such provision or part to any person/s or circumstance/s, is held invalid by the courts of law, the remaining valid provisions of these Guidelines shall not be affected.  

 

          B. Repealing Clause:

 

          All previous guidelines, rules and regulations, and agreements inconsistent with the present Guidelines are hereby repealed or modified accordingly.

 

          C. Effectivity:

 

          These Guidelines shall take effect immediately.
